Just because the urchin stole less or for a different reason, or because the police or prosecuting authority might decide to let him go, doesn't mean he didn't steal.  The desert of punishment is immaterial to the definition of the crime.

Hence, why I said "somewhat". Obviously, the punishment doesn't completely define the crime, but it does to an extent.

You're right.  It isn't larceny.  It's intellectual property infringement, which is actually quite a bit more serious.  Larceny is the taking of physical property, that is, someone's chattels. Intellectual property is the right to profit from and distribute one's own work.  When you copy a DVD, you're not "stealing" the movie itself, but you are infringing on the creator's right to distribute his own work as he sees fit, a right granted and protected by law.

Basically, piracy is a lot like eating meat. The more faceless the cow, the less you care.

I eat meat – but if I had to kill and skin the animals myself, I'd never end up eating meat. By the same token, it's easier to pirate from say, Warner Bros, than it is to pirate from a self-employed free lancing comic artist who publishes his comic through cafepress.com.

Ah yes, the Robin Hood defense.  Sorry, but theft is not defined by need.

But… it's not the Robin Hood defence. If he's the thief, then that means he's Robin Hood. Which in turn means he takes from the rich and gives to the poor. He only does the first part. So… I suppose it's more the Dick Turpin defence?  ??? I dunno.

Also – theft is somewhat defined by need. A needy person is more likely to get away with thievery than another. For example, a street urchin who steals bread is less likely to be punished than say, a office worker who gets his kicks at night by stealing dvd players from other residents. (At least… I would hope so…)

Also – piracy isn't theft. Theft, according to the dictionary, is "the act of stealing; the wrongful taking and carrying away of the personal goods or property of another; larceny." The key is, "carrying away the personal goods or property of another". You don't really do that with piracy. You copy their goods, and then walk away with that copy. They still have their own goods and property.

There's this thing on dvds with X-TREME(!!!) music about how you wouldn't "steal a car" then goes, "piracy is theft". But it should really ask if you would "clone a car" by having a guy walk up to a car, stand next to it for a few hours and slowly build a new car next to it (out of thin air I suppose) and then drive off in it. Thinking about that image always makes me laugh. 😀

I don't pay any money for this sort of material, outside of basic internet/electricity fees of course.  Although, I don't pay money for many forms of media either, whether it be games, movies, television shows etc. unless it's really worth it I find a way around the price.

I'm like that too. I download quite a bit for free, and generally, if I like it, I'll go out and buy it (that's how I got into Firefly). One thing I download a LOT and rarely pay for is tv shows (in that I rarely pay for tv shows I download, but I have loads of dvd box sets of tv shows) – for example, American Gladiators. The reason is that I don't know if and when they'll air over here, and since they're airing for free on tv – basically, in the old days before the internet, you'd record something off tv and keep it. I did that all the time (loads of Simpsons tapes for example). It's weird, I'll burn a dvd of Heroes episodes and people will act like they're getting drugs. If I lived in the US, came over for a week with a set of tapes with Heroes episodes recorded on them, no one would bat an eyelid. Weird.

So, the question is, "how much are you willing to pay" and someone responds with an honest answer (and he wasn't bragging at all), people then post offensive comments at him. He explains his position (without bragging) and gets lambasted further. That's somewhat disappointing.
